These Terms of Use (hereinafter referred to as “these Terms”) set forth the conditions for using the event information website “Iiyama Now” (hereinafter referred to as “the Service”) provided by the Operators.
Users of the Service (hereinafter referred to as “Users”) are required to carefully review and agree to the contents of these Terms before using the Service.
By using the Service, Users are deemed to have agreed to these Terms.
If a User is a minor, they must obtain the consent of their parent or legal guardian before using the Service.
Article 1 (Definitions)
The key terms used in these Terms are defined as follows:
- “Operators” refers to Jae Kim and Laurie Jezekel, members of the Iiyama Community-Reactivating Cooperator Squad, who manage and provide the Service under commission from Iiyama City.
- “Service” refers to the event creation, announcement, and reservation platform, as well as related services provided by the Operators.
- “User” refers to any individual or organization that uses the Service, regardless of whether they have registered as a member.
- “Member” refers to a User who has completed the prescribed membership registration process on the Service. Members are able to create events on the platform.
- “Organizer” refers to a User who creates and hosts events on the Service. A separate organizer registration is required.
- “Participant” refers to a User who makes a reservation or application to attend an event listed on the Service.
- “Event” refers to an activity (such as lectures, seminars, or community gatherings) created by a User (Organizer) on the Service, which is, in principle, held within Iiyama City, Nagano Prefecture, or broadcast online from a venue located in Iiyama City. Events held outside Iiyama City or streamed exclusively from outside the city are not eligible for listing on the Service.
Article 2 (Prohibited Acts)
When using the Service, Users shall not engage in any of the following acts.
However, events conducted in cooperation with or under the auspices of public institutions may be exempted from this restriction.
If a User violates any of the following prohibitions, the Operators may, without prior notice, delete the relevant posts or suspend or terminate the User’s account.
- Registering or promoting events held outside Iiyama City or streamed exclusively from outside Iiyama City.
- Registering or providing false information.
- Impersonating another individual or organization.
- Collecting, using, or providing personal information of other Users without authorization.
- Obstructing the operation of the Service or damaging the reputation or credibility of the Operators.
- Transmitting or posting harmful programs, scripts, or similar content.
- Infringing upon the intellectual property, privacy, reputation, or other rights of the Operators or third parties.
- Defaming, discriminating against, or posting obscene, violent, or otherwise offensive content contrary to public order and morals.
- Using the Service for criminal purposes or to promote or assist criminal activity.
- Engaging in spam or repetitive posting of identical or similar content without authorization.
- Violating laws, ordinances, or public order and morals.
- Promoting, supporting, or opposing specific political parties or factions.
- Proselytizing or promoting, supporting, or opposing specific religions or denominations.
- Any other acts that the Operators deem inappropriate.
Article 3 (User Responsibility)
Users shall use the Service at their own responsibility and are required to manage their account information (including user IDs and passwords) appropriately.
Users are solely responsible for all actions and outcomes performed through their account.
If a User becomes aware of unauthorized use or theft of their account, they must immediately notify the Operators and follow any instructions provided.
Should a User cause damage to another User or a third party while using the Service, they shall resolve the matter at their own cost and responsibility.
If, as a result of the User’s conduct, the Operators receive a claim or suffer damage from a third party, the Operators may seek compensation from the User for such damage.
Article 4 (Limitation of Liability)
The Operators provide the Service as a platform for information sharing and event communication.
The Operators are not involved in, nor responsible for, any interactions or transactions between Users.
Any disputes arising between Users shall be resolved solely between the parties involved.
The Operators are not liable for any damages (including loss of data, service interruptions, indirect or consequential damages) arising from the use or inability to use the Service, except in cases of willful misconduct or gross negligence on the part of the Operators.
Even in cases where the Operators are held liable, the total compensation shall be limited to direct and ordinary damages actually incurred.
The Operators shall not be liable for damages resulting from events beyond their reasonable control, including but not limited to natural disasters, communication failures, system malfunctions, or unauthorized access by third parties.
Article 5 (Use by Minors)
If a User is a minor, they must obtain the consent of a parent or legal guardian (including consent to these Terms) before using the Service.
If a minor uses the Service, it is deemed that such consent has been obtained.
If a User reaches adulthood after agreeing to these Terms, all actions taken while a minor shall be considered ratified.
Some events may have age restrictions or require guardian accompaniment.
Minor Users must comply with the participation conditions set for each event.
Article 6 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the Nagano District Court as the court of first instance.
Article 7 (Validity of Agreement)
If any provision of these Terms is deemed invalid or unenforceable under Japanese law, the remaining provisions shall continue to remain in full force and effect.
Any invalid or unenforceable provision shall be replaced by a valid one that most closely reflects the original intent of the provision.
Article 8 (Revisions to the Terms)
The Operators may revise these Terms at any time without prior consent of the Users when deemed necessary, including but not limited to legal changes or updates to the Service content.
Revised Terms shall take effect upon publication on the Service.
By continuing to use the Service after such publication, Users are deemed to have agreed to the updated Terms.
However, if changes significantly affect Users’ rights or obligations, the Operators will provide prior notice with a reasonable grace period.
Article 9 (Notifications)
Notices from the Operators to Users shall be made through in-service announcements, email to the registered address, or other appropriate means.
Such notices shall be deemed effective at the time they are sent.
Users shall contact the Operators through the designated method when making inquiries or communications.
Article 10 (Supplementary Provisions)
These Terms take effect on April 1, 2025.
